SMS Proof of Consent

This page documents how NovaGuard Technologies, Inc. (“NovaGuard,” “we,” “our,” or “us”) obtains express written consent from end users before sending SMS/MMS text messages related to the Constant Guardian® platform. It is provided for transparency to customers, end users, and messaging carriers (including Twilio) reviewing our messaging program.

2. How & Where Consent Is Collected

Consent is collected exclusively within the authenticated Constant Guardian product environment. Only authorized users of a customer’s Constant Guardian account — after they have logged in — can enroll in SMS notifications. No SMS opt-in is collected from this public website, and phone numbers are never purchased, rented, or imported from third-party lists.

The opt-in is entirely user-initiated:

  1. The user logs into the Constant Guardian web dashboard or mobile application.
  2. The user navigates to Account Settings → Notifications → SMS Alerts.
  3. The user enters their mobile phone number.
  4. The user reads the disclosure text shown below and actively checks an unchecked-by-default consent checkbox.
  5. The user clicks “Enable SMS Alerts” to submit the request.
  6. NovaGuard sends a one-time verification code to the supplied number, which the user must enter back into the dashboard to confirm ownership of the device.
  7. Only after successful code verification is the number enrolled and a welcome message sent.

The screen below is a faithful reproduction of the SMS enrollment screen presented to users inside the Constant Guardian product. The consent checkbox is unchecked by default and the “Enable SMS Alerts” button is disabled until the user actively checks the box.

4. Exact Disclosure Text Presented to Users

The full text of the disclosure shown above — word for word as it appears next to the consent checkbox — is reproduced below for review:

“I agree to receive recurring automated text messages from NovaGuard Technologies, Inc. at the mobile number provided. Messages will include security alerts, incident notifications, and system status updates from Constant Guardian®. Message frequency varies and is typically 1–5 messages per week. Message and data rates may apply. Reply STOP to unsubscribe at any time, or HELP for help. Consent is not a condition of purchase. Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. By checking this box, you confirm you have read and agree to our SMS Terms and Privacy Policy.”

5. Welcome & Sample Messages

After successful opt-in and verification, the user receives a welcome message. Subsequent messages fall into one of the categories below.

Welcome Message (sent once after enrollment):

NovaGuard CG: You’re now subscribed to Constant Guardian SMS alerts. Msg freq varies (~1–5/wk). Msg&data rates may apply. Reply HELP for help, STOP to cancel.

Sample Security Alert:

NovaGuard CG Alert: Critical anomaly detected on Site-A PLC-03 at 14:22 UTC. Severity: HIGH. Investigate via dashboard. Reply STOP to opt out.

Sample Status Update:

NovaGuard CG: Daily summary — 0 incidents, 12 sites healthy, 1 advisory. View details in dashboard. Reply STOP to opt out.

Sample Operational Notification:

NovaGuard CG: Sensor 4 at Plant-2 returned to NORMAL at 09:15 UTC. No further action required. Reply STOP to opt out.

6. HELP and STOP Keyword Handling

NovaGuard honors all standard messaging keywords as required by carrier and CTIA guidelines.

STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT) — user receives:

NovaGuard CG: You have been unsubscribed from Constant Guardian SMS alerts. You will receive no further messages. Reply START to resubscribe.

Following a STOP request, no additional marketing or promotional messages will be sent to that number. The number is also flagged in the Constant Guardian platform so that re-enrollment requires the user to repeat the full opt-in flow described in Section 2.

7. Recordkeeping

For every opt-in, NovaGuard records and retains the following evidence of consent for at least the duration of the subscription plus four (4) years:

8. No Sharing of Mobile Information

Mobile information (including phone numbers and SMS opt-in data) is never shared with third parties or affiliates for marketing or promotional purposes. Phone numbers are used only to deliver the messages described in this document. Limited operational sharing with our messaging service provider (Twilio Inc.) is required solely to transmit the messages and is governed by Twilio’s own data-protection commitments.
