Privacy Policy

NovaGuard Technologies, Inc. (“NovaGuard,” “we,” “our,” or “us”) operates the Constant Guardian® platform and the websites located at constantguardian.com and novaguardtech.com (collectively, the “Services”). This Privacy Policy explains what information we collect, how we use it, and the choices available to you.
1. Information We Collect
1.1 Information You Provide Directly
- Contact information: name, business email, business phone, company, and job title submitted through contact or demo-request forms.
- Account information: credentials, organization, role, and preferences associated with a Constant Guardian customer account.
- Mobile telephone number and SMS preferences, if you elect to enroll in SMS notifications inside the Constant Guardian product (see Section 5).
- Communications: any messages, files, or feedback you send to us.
1.2 Information Collected Automatically
- Usage data: pages visited, features used, timestamps, and referring URLs.
- Device data: IP address, browser type, operating system, and device identifiers.
- Cookies and similar technologies used to keep sessions active and to measure aggregate site usage. You can disable cookies in your browser, but parts of the Services may not function correctly.
1.3 Information from the Constant Guardian Platform
When the Constant Guardian software is deployed inside a customer’s operational technology (OT) environment, it processes telemetry, network metadata, and security events from that environment in order to detect anomalies and incidents. This data is processed on behalf of the customer under the customer’s subscription agreement and is not used for any of our own marketing or advertising purposes.
2. How We Use Information
We use the information we collect to:
- Provide, maintain, and improve the Services;
- Authenticate users and secure customer accounts;
- Send security and incident alerts, status updates, and operational notifications (including via SMS, where the user has opted in);
- Respond to inquiries, support requests, and demo requests;
- Send service-related communications such as account, billing, and policy-update notices;
- Detect, prevent, and respond to fraud, abuse, security incidents, and violations of our terms; and
- Comply with legal obligations.
3. How We Share Information
We share personal information only in the limited circumstances described below.
- Service providers and processors who perform functions on our behalf — for example, cloud hosting, email delivery, and SMS transmission (Twilio Inc.). These providers may process information only as necessary to perform their service for us and are bound by contractual obligations to protect that information.
- With your customer organization, if you use the Services through an enterprise account — account administrators may have access to usage and account information associated with that organization.
- Legal and safety reasons, when we believe disclosure is required by law, subpoena, court order, or other legal process, or to protect the rights, property, or safety of NovaGuard, our customers, or others.
- Business transfers, in connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to standard confidentiality protections.
4. We Do Not Sell Your Information
We do not sell personal information. We do not share personal information with third parties or affiliates for their own marketing or promotional purposes.
5. SMS / Text Messaging Privacy
Mobile information (including telephone numbers and SMS opt-in data) is not shared with third parties or affiliates for marketing or promotional purposes. No mobile information collected as part of the SMS program will be sold or shared for marketing.
If you opt in to receive SMS messages from Constant Guardian:
- We collect your mobile telephone number, the timestamp of opt-in, the IP address and user-agent of the submitting device, and the version of the disclosure text you agreed to.
- Your number is used solely to deliver the messages described in our SMS Messaging Terms and our SMS Proof of Consent page.
- Your number is shared with our messaging service provider (Twilio Inc.) only to the extent necessary to transmit the messages.
- You may opt out at any time by replying STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT) to any message. You may obtain help by replying HELP, by emailing info@novaguardtech.com, or by calling +1 (281) 364-9832.
- Standard message and data rates from your mobile carrier may apply. NovaGuard does not charge for the messages.
6. Data Retention
We retain personal information for as long as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Records of SMS consent and keyword events are retained for at least the duration of the subscription plus four (4) years to comply with messaging-program record-keeping obligations.
7. Security
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and at rest where appropriate, access controls, and audit logging. No system is perfectly secure; we cannot guarantee absolute security and ask that you use a strong, unique password and notify us promptly of any suspected unauthorized access.
8. Your Choices and Rights
- Access, correction, and deletion: You may request access to, correction of, or deletion of personal information you have provided by contacting us at info@novaguardtech.com.
- Marketing email: You may unsubscribe from marketing email at any time using the link in the message or by contacting us.
- SMS opt-out: Reply STOP to any message, or contact us as described in Section 5.
- State-specific rights: Residents of certain U.S. states (including California) and other jurisdictions may have additional rights under applicable privacy law, such as the right to know, correct, delete, and (where applicable) opt out of certain processing. Contact us to exercise these rights; we will not discriminate against you for doing so.
9. Children’s Privacy
The Services are intended for business and operational use and are not directed to children under the age of 13. We do not knowingly collect personal information from children under 13.
10. International Users
NovaGuard is based in the United States. If you access the Services from outside the United States, your information will be transferred to, stored in, and processed in the United States and other jurisdictions in which our service providers operate.
11. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page and revise the “Last Updated” date above. Material changes will be communicated via email or through the Services where required by law.
