SMS Messaging Terms & Conditions

These SMS Messaging Terms & Conditions (“SMS Terms”) govern your enrollment in and use of the Constant Guardian text-message notification program (the “Program”) operated by NovaGuard Technologies, Inc. (“NovaGuard,” “we,” “our,” or “us”). By opting in, you agree to these SMS Terms and to our Privacy Policy.

1. Program Description

The Program delivers automated text messages from NovaGuard, in connection with the Constant Guardian® OT/ICS network monitoring platform. Messages are limited to:

2. How to Opt In

You may enroll in the Program only from within the authenticated Constant Guardian product (web dashboard or mobile application) by entering your mobile telephone number, actively checking an unchecked-by-default consent checkbox, and confirming the verification code we send to your device. The exact opt-in flow and disclosure text are documented on our SMS Proof of Consent page. Consent is not a condition of any purchase.

3. Sending Number

Messages are sent from 1-833-322-7354 (toll-free). We may, after notice to you, send messages from additional numbers we control if required for redundancy or carrier compliance.

4. Message Frequency

Message frequency varies based on the volume of security events and operational activity in your monitored environment. Subscribers typically receive between 1 and 5 messages per week.

5. Cost

NovaGuard does not charge a fee for participation in the Program. Message and data rates from your mobile carrier may apply. You are responsible for any charges your carrier imposes for sending or receiving text messages.

6. How to Opt Out

You may cancel the Program at any time by replying STOP (or any of STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT) to any message we send you. You will receive a one-time confirmation that you have been unsubscribed; after that, no further messages will be sent unless you re-enroll. To re-enroll, repeat the opt-in flow inside the Constant Guardian product.

8. Carrier Disclaimer

Wireless carriers (including but not limited to AT&T, T-Mobile, Verizon Wireless, and Sprint) are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission from the network operator and is outside our control.

9. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to enroll in the Program. You must be either the subscriber to, or a customary user with authority over, the mobile telephone number you provide. By enrolling you confirm that you have such authority and that the device on which you receive messages is your own.

10. Privacy

Information you provide as part of the Program is handled in accordance with our Privacy Policy. Mobile information (including phone numbers and SMS opt-in data) is not shared with third parties or affiliates for marketing or promotional purposes.

11. Changes to These Terms

We may update these SMS Terms from time to time. Material changes will be communicated to you through the Constant Guardian product, by email, or by SMS where required by law. Continued participation after a change becomes effective constitutes acceptance of the updated SMS Terms.
